KUALA LUMPUR: A haircare products company and two of its directors have filed a suit against the assembler and local dealer of a premium continental vehicle, claiming the car was defective and had been recalled prior to the purchase. They claimed this information was not disclosed to them before the purchase in November 2022.In a report today by the portal Free Malaysia Today, the plaintiffs claimed the vehicle had recurring electronic and mechanical issues since it was delivered on Nov 25, 2022, and that the model was recalled on March 2022.
"The defendants deliberately withheld this critical information," the plaintiffs alleged in their statement of claim filed through law firm V. Siva & Partners.The plaintiffs — Beyond Natural Group Sdn Bhd, S.
Aruna and G. Hanulraj — said they had lost trust and confidence in the three-litre vehicle that they acquired for RM506,246.04.
The duo are seeking an order from the Sessions Court to compel the dealer to take the car back and for general and aggravated damages.The suit, filed on Tuesday, also sought the reimbursement of RM54,246.04 in loan interest and hire-purchase loan sum of RM452,000, as well as any future hire purchase agreements with Affin Bank Bhd.
The plaintiffs also sought the reimbursement of RM157,600 for monthly instalments paid to date, RM11,219.90 for the insurance premium, RM6,618.15 in service charges and RM12,800 for the cost of paint protection film.
The pair also sought general damages for pain, suffering, stress, mental anguish and trauma caused by the defendant in the ordeal.It was reported that the plaintiffs were induced to purchase the car based on representations and assurances made by the defendant, both through a brochure and verbal representations, that the vehicle was a luxury premium product equipped with essential features.But by December 2022, they began encountering issues with the car.
On Dec 2, 2022, the plaintiffs sent an email requesting a replacement vehicle, but only received an acknowledgement for the email. No remedial actions were taken. "The lack of engagement from the defendants only intensified (the plaintiffs') frustration, leading to a sense of being trivialised and completely disregarded," FMT quoted the lawyer as saying.
It added that the plaintiffs refused to collect the vehicle after its most recent repair on Dec 27 last year. They demand monetary compensation. © New Straits Times Press (M) Bhd.
