Burglary accused Ross Kashka Haynes was advised not to even “dream about” the complainant in his matter.Haynes, 23, of Evergreen Close, Hillbury, Workman’s, St George, returned to the District “A” Magistrates’ Court No. 2 on Wednesday after being remanded when he first appeared in relation to the April 12 charge of entering Sharian Griffith’s home as a trespasser, with intent to unlawfully damage the building.
He has denied the charge.Acting Magistrate Bernadeth John gave the accused a strict directive not to have any contact whatsoever with the complainant.He was eventually granted $5 000 bail after submissions by both the prosecution and the defence.
However, the accused was informed by the court that his bail had turned solely on the basis that the complainant “is not in the jurisdiction”.That aside, should she return to the island at any point “and you so much as breathe in her direction, bail will be revoked”, the acting magistrate emphasised.“Zero contact.
Do not call, do not contact her via social media. If you’re dreaming about her, wake up. What I do not want is for this to escalate,” she warned.
In considering whether to grant Haynes bail, she said it “ought not to be unreasonably withheld, but conditions will be put in place”. Defence attorney Amilcar Branche submitted that when a previous order had been put in place for a year (regarding the same complainant), Haynes had not breached it then and he therefore did not expect him to do so this time around.The accused was ordered to surrender his passport and report to the Boarded Hall Police Station every Wednesday and Saturday by noon.
