Excelsior CorrespondentSrinagar, Apr 19: High Court has allowed the Press Club of Kashmir to operate the accounts of the club in the J&K Bank with conditions.The club has moved to High Court through its president Mohammad Saleem Pandit seeking direction on J&K Bank to allow the club to permit the petitioner-club to operate its bank accounts maintained in the branch of Polo View Srinagar.Justice Javed Iqbal Wani directed the Bank to allow the club to operate the accounts subject to the condition that in case the club lost the case, the amount of the club account will be reimbursed.

Respondents are directed to allow the petitioner- club to operate the bank accounts claimed to have been operated by the petitioner- club, subject to filing of undertaking before the Registrar Judicial of this Ccourt to the effect that in case the petition fails, the amount presently in the aforesaid accounts will be reimbursed”, Justice Wani directed.The club through its president alleges the arbitrary and unjustified refusal of bank to allow the petitioner to operate its bank accounts, despite the fact that the petitioner-society stands duly registered under the Societies Registration Act.It has been contended that the club was initially registered and later re-registered under the Act, in compliance with the statutory requirements flowing the enactment of J&K Re-Organization Act 2019.
“Despite the completion of all requisite formalities the absence of any legal impediment, the bank has unjustifiably withheld the access to the petitioner’s accounts, thereby bringing its activities to a standstill”, the club pleads.The club submits that during the pendency of its registration process, an attempt was made to unlawfully seize control of its management and as precautionary measure the bank temporarily restricted the operation of accounts.“That now the petitioner-society stands duly registered under the Act, there exists no legal or factual impediment to the operation of its bank accounts.
