The victim returned and found a "white substance" on her bed and toys. Yadav confessed to the crime after he was linked to the offence by DNA evidence and said he had acted out of "sexual frustration". He also admitted he knew the card system that had given him access to the other rooms was faulty.
Court Decision and Sentence Information
Yadav was accused of burglary with intent to commit damage to property. He was given a 14-month suspended jail sentence, which means he won't go to prison if he stays out of trouble for two years. He was also ordered to carry out 200 hours of unpaid work and to undertake rehabilitation. He was also told to pay GBP 117 in compensation for damage to three soft toys and the bed cover.
Yadav's lawyer argued that the man could not be held responsible for the posts while adding that his client, whose father owns a construction business in India, had no previous record and immaturity. She added that he had aspirations to study for a Master's in the UK and wanted to give something back to society. But now the university is reconsidering his student visa and he may be kicked out and sent to Indonesia.
Trauma of the Victim and the Observations of the Courts
The victim said, in the impact statement, that the break-in has had a "profound psychological effect" on her, feeling "fear, distress and violation" when she knew that "someone had engaged in a sexual act" in her personal space when she left behind pictures of her on her walls. The judge, Mark McKone KC, decried Yadav's behaviour as "disgusting and selfish." He observed that the student must have been aware of the emotional distress that a deed like that would have, particularly for someone who was experiencing the feeling of being away from home for the first time.
Yadav has been instructed to move to separate housing and is now awaiting the university's final word on his academic and immigration status.
